Online Reservation System Terms of Service
The following Terms of Service apply to the use of the Online Reservation System (hereafter the “System”) by companies, groups, or individuals (hereafter the “Customer”) as dictated by Bagus Co. Ltd. (hereafter the “Company”). Please carefully read these Terms and Conditions before using the System.
(General Compliance)
Article 1
Customers are required to adhere to generally accepted manners, morals and technical rules when using the System.
The use of the System for profit, for any reason, such as arranging reservations on behalf of another party etc. is strictly forbidden.
(Measures Taken when General Compliance is Infringed Upon)
Article 2
The Company and affiliated Hotels reserve the right to refuse service to Customers deemed to be using the Service in an inappropriate way such as may cause others to be put in a troublesome or disadvantageous position, or interfere with the service of the Hotel using the System.
(Effects Caused by the Usage Environment of the Customer)
Article 3
The System can be used by Customers whose various character display (Japanese character display) and e-mail settings are correctly set. The Company and Hotel bear no responsibility for the working result, or connection status, or any results caused by, the actions of Customers who do not meet these criteria. Even if the above conditions are met, the same applies for any instances in which the System does not function properly due to reasons other than those caused by the Company and/or Hotel such as various circumstances regarding the Customer’s computer set-up.
(Conditions for System Users)
Article 4
Only Customers who have agreed to the Terms of Service may use the System. By completing a reservation using the System the Customer is deemed to have accepted this agreement and is expected to comply with the Terms of Service.
In using the System, the Customer agrees to adhere to this agreement. When making a reservation using the System the Customer is required to register his/her name, address, telephone number, email address etc.
There is a limit to the content of the accommodation services that the System can provide, Customers must agree not to seek further services or price reductions.
(Services Provided by the System)
Article 5
It is possible to reserve certain products provided by the Hotel through the homepage run by the Company.
(Compliance with Rules of Use)
Article 6
In the event Customers using the System use a room provided by the Hotel, they are required to abide by the “Terms and Conditions for Accommodation Contract” and “Facility Terms of Use” provided by the Hotel.
(Points to be Aware of when Using the System)
Article 7
Reservations made using the service provided by the System do not receive higher priority than those made through other means (Telephone reservations, fax reservations, reservations made through other hotels etc.) and as such, there is the possibility that reservations cannot be made if the Hotel is fully booked.
(User Responsibilities)
Article 8
By using the System, Customers agree to accept responsibility for any actions taken by themselves, and/or any actions, and the results thereof, conducted using the Customer’s e-mail account. In addition, by using the System, with the exception of cases caused by negligence on the part of the Company and/or Hotel, the Customer accepts all responsibility for any actions that may negatively affect a third-party, and agrees to resolve any potential issues that arise with said third-party themselves.
If the Company, Hotel or System incur any damages due to a Customer engaging in any of the following activities, the Company and/or Hotel will seek compensation from the Customer for the full amount of damages caused.
- (1)Any breach of this agreement or the separately determined Terms of Service for Accommodation Contracts or Terms of Use for Facilities of the Hotel.
- (2)Any reservation for accommodation made with false or misleading information.
- (3)Completing user registration or reservations for a third-party without said individual’s consent.
- (4)Transmission or creation of harmful programs.
- (5)Entering or sending information pertaining to a third-party without said individual’s consent.
- (6)Any conduct that violates current Japanese law.
(Reservation Request)
Article 9
Please correctly enter the required personal data into the reservation request form for the desired plan.
If insufficient data is entered into the reservation request form, the reservation may be deemed invalid.
(Reservation Approval)
Article 10
Reservations made through the Service are completed either when a reservation number is displayed on the internet browser, or when a reservation confirmation e-mail has been received by the Customer. At this point an accommodation contract between the Hotel and the Customer will be considered to have been formed.
(Payment)
Article 11
The final cost for reservations made through the System shall be included in the reservation conformation e-mail sent from the Company to the Customer. The cost is to be paid at the Hotel upon check-in through the method the Hotel designates. In the event additional costs are incurred separate from the reservation, they are to be settled by the Customer at the Hotel.
(Reservation Cancellations/Changes)
Article 12
In the event the Customer wishes to cancel or alter his/her reservation, the Customer is responsible for contacting the Hotel either through the Service or by telephone.
In the event the Customer wishes to cancel all or part of his/her reservation the Hotel will receive a cancellation fee as per the Terms and Condition for Accommodation Contracts.
(Changes in System Content)
Article 13
System management and this agreement may change without notice if such changes are deemed necessary by the Company and/or Hotel. Please be sure to always read this agreement before using the System.
In addition, in the event of changes to this agreement, only the most up-to-date version retains its validity.
(Temporary Suspension of Use)
Article 14
Use of the System may be temporarily suspended without prior notice to the Customer in the event of the following circumstances:
- ● When the System requires maintenance.
- ● In the event type-1 telecommunications providers temporarily suspend telecommunications services and the operation of the Service becomes difficult.
- ● Blackouts, fires, strikes, labor disputes, or other industrial disturbances, natural disasters, unavoidable accidents, regulations, administrative guidance, administrative discipline, court order, civil war, riot, epidemic, or any other reason beyond the control of the Company and/or Hotel which makes operation of the System difficult.
- ● When the Company deems it necessary to temporarily suspend System use due to other reasons regarding the Hotel homepage or System management.
(Handling of Guest’s Personal Information)
Article 15
Personal information registered will be used to confirm the content of the reservation and to contact the Customer. Customer’s personal information will be handled in accordance to the Company’s “Personal Information Protection Policy”, by using the System the Customer is assumed to be in agreement with the policy. (Governing Laws Regarding System Use)
Article 16
The System is used in accordance with current Japanese laws.
(Court Jurisdiction Regarding System Use)
Article 17
If there is a question regarding interpretation, etc. or a dispute between the parties concerned regarding the use of the System, the parties are to do everything in their power to resolve said disagreement in good faith. In the event that, even after consultation, the parties are unable to come to an understanding, the Tokyo District Courts have exclusive jurisdiction over the agreement.
Supplementary provision. This law will come into force on August 1st 2017.
